What is DPO as a Service?

It is outsourcing the role of the DPO responsible for personal data processing, as required by the LGPD. The DPO communicates with data subjects and with the ANPD (Brazil's data protection authority) and advises the company. Taura can combine this role with privacy management services, without transferring the controller's responsibilities.

Frequently asked questions

Does every company need a DPO?

It depends on the processing agent's role and the applicable rules. The ANPD provides exemptions for small processing agents, under conditions, and a communication channel for data subjects is still required. It is worth checking how the rules apply to your company.

Can the DPO be external?

Yes. The role can be outsourced, as long as the appointment and working conditions meet the rules and the DPO has the means to perform the role.

What is the deadline to report an incident to the ANPD?

When there is relevant risk or harm to data subjects, the general rule requires notifying the ANPD and the data subjects within three business days of becoming aware of the incident. There are conditions and exceptions, including for small processing agents.

Does hiring a DPO guarantee LGPD compliance?

No. The DPO supports the organization, but compliance depends on the company's practices, controls and decisions.
